Terms of use — Fifth Third Edition
These terms govern every workspace, every module install and every subscription on the Fifth Third Edition of FifthThirdStore. They enter into force on 2026-01-01 and supersede any earlier version.
1. Publisher
The service you are using is operated by FifthThirdStore d.o.o., a limited-liability company registered in Podgorica, Crna Gora. Registered office: ul. Vaka Đurovića 12, 81000 Podgorica. PIB: 02947183. CRPS: 4-0088912/5. Legal representative: Stefan Popović. Contact: support@fifththirdstore.org, +382 20 445 906. The company is registered with the Crnogorska komercijalna banka under IBAN ME25 510 0000 0004 8371 24.
These terms are drafted in English. The Montenegrin translation is available on request; in the event of discrepancy the English text prevails for parties whose workspace address is outside Crna Gora, and the Montenegrin text prevails for parties resident in Crna Gora.
2. Definitions
«Service» means the FifthThirdStore website, the workspace application and the marketplace API operated by the Publisher. «Fifth Third Edition» is the current quarterly shelf name for every module offered on the Service. «Fifth Third module» means any Android application published to the Fifth Third Edition shelf and signed with the Fifth Third release key. «Workspace» means the customer account provisioned when a user installs the FifthThirdStore workspace application. «Enrolled device» means an Android device on which a workspace is signed in and one or more Fifth Third modules are installed. «Fifth Third Wednesday drop» means the weekly release cadence on which new modules, updates and maintenance patches land on the Service.
3. Scope of the service
The Service ships small-footprint Android modules on a monthly subscription. Every Fifth Third module is signed with the Fifth Third release key and installs through the standard Android PackageInstaller. The Service does not modify system firmware, does not require root privileges (except for a single opt-in feature on BatteryProfile Pro), and does not interact with hardware outside the module’s own package permissions.
The Fifth Third Wednesday drop is the standard release cadence. The Publisher may issue off-cadence maintenance releases when a module ships a defect that affects safety, privacy or fundamental function. Off-cadence releases are documented on the Fifth Third changelog with the same rigour as a Wednesday release.
4. Formation of the contract
The contract between you and the Publisher is formed at the moment your first workspace is provisioned. The provisioning email confirms the modules queued at checkout, the total monthly amount and the first billing date. If any element of the confirmation is incorrect you have fourteen calendar days to notify the Publisher and have the workspace suspended without further charge.
5. Subscription and price
Every Fifth Third module carries a monthly subscription in euro. The price listed on the module data sheet at the moment you queue it is the price that applies for the first twelve months of the workspace. After twelve months the Publisher may adjust the price with a thirty-day notice on the workspace email. You may cancel the affected module before the new price takes effect. The three workspace tiers (Fifth Third Solo, Fifth Third Studio, Fifth Third Fleet) are billed monthly and independently of the modules provisioned to the workspace.
The first month of every Fifth Third module queued on a workspace is included in the workspace subscription. The included month does not roll over: it is spent on the modules provisioned on the day the workspace is first installed.
6. Payment
Payment is by card or by SEPA direct debit. The Publisher does not accept crypto-asset payments, gift cards, mobile-carrier billing or cash. Invoices are issued monthly, in euro, from FifthThirdStore d.o.o. in Podgorica. Every workspace receives a monthly invoice as a signed PDF on the first calendar day of the month. A company account can add a VAT number at checkout for reverse-charge invoicing where the Publisher’s VAT registration permits.
7. Right of withdrawal
A consumer resident in the European Economic Area has a right of withdrawal of fourteen calendar days from the workspace provisioning date, exercisable by email to support@fifththirdstore.org with the workspace reference. The consumer is refunded within fourteen days of receipt of the withdrawal notice, using the same payment method as the original transaction. The right of withdrawal is extinguished for a module the consumer has expressly requested and used more than a single time — for those modules a pro-rata refund of the current month applies instead.
8. Availability and continuity
The Publisher targets a marketplace-API availability of 99.6 % on a monthly basis. Availability is measured against the /v1/health endpoint and does not count scheduled maintenance announced at least seventy-two hours in advance. Modules already installed on an enrolled device continue to function during a marketplace-API outage; only the auto-update track and the provisioning of new modules are affected.
9. Fair use
A workspace enrols up to three Android devices per seat on the Fifth Third Solo tier, up to three on the Fifth Third Studio tier (times five seats) and up to three on the Fifth Third Fleet tier (times twenty seats). A device that has not signed into the workspace for ninety consecutive days is automatically unenrolled to free the slot for another device.
The workspace credentials are personal. Sharing them with a party outside the workspace organisation is a material breach of these terms. The Publisher may suspend a workspace on detection of concurrent sign-ins from more than three geographically distant IPs within a single hour, pending review by the workspace administrator.
10. Intellectual property
The FifthThirdStore name, the Fifth Third Edition shelf name, the Fifth Third release key and the marketplace API interface are the intellectual property of the Publisher. Each Fifth Third module remains the intellectual property of its developer, licensed to you on a personal, non-transferable, revocable basis for the duration of the module subscription. Reverse engineering of a module beyond what is permitted by the Zakon o autorskim i srodnim pravima of Crna Gora is prohibited.
11. Liability
The Publisher is liable for direct, foreseeable damage caused by its negligence, up to a per-workspace annual cap of the amount actually paid by the workspace to the Publisher in the twelve months preceding the loss. Indirect damage (loss of business, loss of data on a device that has not been backed up, reputational damage) is excluded to the extent permitted by mandatory consumer law. The Publisher does not assume liability for damage caused by the misconfiguration of an enrolled Android device by the workspace user.
12. Termination
You may cancel any Fifth Third module from the workspace at any time. The module keeps running until the end of the current paid month. On expiry the workspace entitlement is revoked and the module stops receiving updates on the Fifth Third Wednesday track. Local data stays on the device.
The Publisher may terminate the workspace with immediate effect on a material breach (payment default of more than thirty days, sharing of workspace credentials, violation of the acceptable-use policy). Termination for other reasons carries a thirty-day notice on the workspace email.
13. Governing law and jurisdiction
These terms are governed by the law of Crna Gora, in particular the Zakon o obligacionim odnosima, the Zakon o zaštiti potrošača, the Zakon o elektronskoj trgovini and the Zakon o zaštiti podataka o ličnosti, and by the General Data Protection Regulation (Regulation 2016/679/EU) for parties within the European Economic Area. The competent court is the Osnovni sud u Podgorici. A consumer resident in the European Economic Area retains the right to file suit before the court of the consumer’s ordinary residence.
14. Amendments
The Publisher may amend these terms with a thirty-day notice on the workspace email. An amendment that materially changes the balance of the contract entitles you to cancel the workspace without further charge. Continued use of the workspace after the amendment enters into force is deemed acceptance of the amended terms.
